ICT is a specialized profession with special people. Speedy and practical solutions are a must in order to provide adequate legal support to them. The time of verbal agreements that where confirmed on the back of a beer-coaster, is long gone in the ICT-branche. Solid contracts are becoming increasingly the norm. The trick is to avoid being dragged into a theoretical legal discussion, but to continually keep the commercial interest of the customer in mind.

When you say “ICT” to us we immediately think of:

• an extensive package of contracts and conditions, for example for delivery and purchase, licenses, maintenance and support, SLA, outplacement, escrow, transfer of intellectual property, distribution, agency, VAR, ASP, non-disclosure agreements, etc.
• continuity constructions with regard to source codes and the securing of intellectual property;
• misunderstandings or disagreements regarding delivery times, errors versus extra functionality;
• FENIT (standard general conditions drafted by the ICT branch organization in the Netherlands) and BiZa (standard purchase conditions drafted by the Dutch government) terms and conditions.
